Basics
- Kreatura, the author of LayerSlider (“the Product”), retains ownership of the Product but grants you the license on the following terms and conditions.
- This license grants you an ongoing, non-exclusive, worldwide license to make use of the Product you have purchased.

You are licensed to use the Product to create a single End Product for yourself or for a client.
Freelancers and creative agencies: You may purchase LayerSlider on your client’s behalf and charge for your services, but you can’t use a license on multiple clients or jobs.

An End Product is one of the following things, both a work that incorporates the Product as well as other things, so it is larger in scope and different in nature than the Product:
For example, you cannot make another slider or animation plugin and cannot offer a service of such based on or powered by LayerSlider or its First Party components.

For example: You are purchasing the Product to your or your client’s website to customize its content. Each website requires its own separate license.

A template or theme with an In-Stock license.
For example: You are purchasing an In-Stock license for the Product in order to make a template to be Sold. Additional terms and conditions apply, please read the relevant section for In-Stock usage.

License bundles offered for multiple websites are the equivalent of purchasing licenses in bulk. The selected number of websites is the number of licenses you purchase in a single step. License bundles may be combined into a single item with a single license key, but they are considered multiple licenses.
For example, if you’ve purchased a Professional license for 5 sites, then you have 5 individual licenses of which each of them can be used for a single site. Thus it does not contradict the “single application” nature of these license terms.
What you can do with the Product
- You can create one End Product for yourself or for a client. You can transfer or Sell that single End Product to your client for any fee. This license is then transferred to your client.
- You can modify or manipulate the Product. You can combine the Product with other works and make a derivative work from it. The resulting works are subject to the terms of this license. You can do these things as long as the End Product you then create is one that is permitted under this license.
Things you can’t do with the Product

This license is a “single application” license and not a “multi-use” license, which means that you cannot use the Product to create more than one unique End Product.
Again, license bundles offered for multiple sites are considered multiple licenses, so it does not contradict these terms.

You can’t re-distribute the Product as stock. You can’t do this with the Product either on its own or bundled with other items, and even if you modify the Product. You can’t re-distribute or make available the Product as-is or with modifications. These things are not allowed even if the re-distribution is for Free.
Purchasing an In-Stock license is an exception if you want to bundle LayerSlider in a WordPress theme for example. Additional terms and conditions apply, please read the relevant section for In-Stock usage.

You cannot use the Product in any application allowing an end user to customise a digital or physical product to their specific needs, such as an “on demand”, “made to order” or “build it yourself” application. You can use the Product in this way only if you purchase a separate license for each final product incorporating the Product that is created using the application.
Examples include, but not limited to, website builders or other content creator or generator applications.

Although you can modify the Product and therefore delete unwanted components before creating your single End Product, you cannot extract and use a single component of the Product on a stand-alone basis.
LayerSlider contains several high-quality and custom-made components that could be an independent product on its own. For example, the modal window script we use in LayerSlider. You are not allowed to extract and use these components on their own outside of LayerSlider.

You must not permit an end user of the End Product to extract the Product and use it separately from the End Product.
A license is for a single End Product. Multiple websites need their own individual licenses, thus you or your client’s are not allowed to re-use LayerSlider across projects or websites without purchasing additional licenses.
Other license terms

Some components of the Product will be sourced from elsewhere and different license terms may apply to these component, such as someone else’s license or an open source or creative commons license. Third party components are identified in the Product’s documentation. The other license will apply to these components instead of this license. This license will apply to the rest of the Product.
Examples include stock photos we may use in slider templates as well as popular JavaScript libraries like jQuery, GreenSock, or CodeMirror.

The Product may be partially subject to the GNU General Public License (GPL) or another open source license: a “split license” applies. This means that the open source license applies to an extent that is determined by the open source license terms and the nature of the Product, and this license applies to the rest of the Product.
Oversimplified, in the land of WordPress it means that the PHP component and integrated HTML are partially or fully covered by the GPL since they rely on WordPress’ codebase to a certain degree. The rest of the components created (such as the CSS, JavaScript, images, design, etc) are covered by Kreatura’s license.

You can only use the Product for lawful purposes. You cannot use the Product directly or indirectly that violates any applicable law, statute, ordinance or regulation.
For example, if the Product contains an image of a person, even if the Product is model-released you cannot use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.
- The Product may contain digital versions of real products, trademarks or other intellectual property owned by others have not been property released. These are licensed on the basis of editorial use only. It is your responsibility to consider whether your use of these items requires a clearance and if so, to obtain that clearance from the intellectual property rights owner.
- This license applies in conjunction with the Terms of Use. If there is an inconsistency between this license and the Terms of Use, this license will apply to the extent necessary to resolve the inconsistency.
- This license can be terminated if you breach it. Severe violations of the licensing terms might result an automatic termination without notice. Upon termination, you must stop making copies of or distributing the End Product until you remove the Product from it. You shall cease all use and destroy or remove all copies, full or partial, of the Product in all devices and media that are in your possession or control.
In-Stock Usage
In addition, the following terms and conditions also apply to developers and authors who want to bundle the Product in their End Product (e.g a WordPress theme) and distribute it either for free or for a price.
Quick Summary – for those who don’t like reading legal documents.
- You need to purchase a separate In-Stock license for each End Product that bundles LayerSlider.
- You need to register your theme on the following URL: kreaturamedia.com/in-stock/
- Don’t offer LayerSlider as a stand-alone product and use proper protection when offloading it.
- You can modify, customize and make use of LayerSlider’s components for LayerSlider-related integrations.
- You can sell millions and we don’t ask for a cut, but you need to provide updates and support for your customers.
- Avoid misleading statements. Do not change the branding. Do not manipulate Product Activation related elements.
- Don’t worry if you mess something up. We’ll be friendly and only take actions in predatory cases.

Each and every End Product requires purchasing separate In-Stock licenses. Variations of the Product such as platform specific releases are considered different products and they require individual licenses in case you want to include multiple versions. If a Product variation does not offer an In-Stock license, then that variation cannot be used as stock.
A single In-Stock license is only valid for a single End Product. For example, if you have three WordPress themes and plan to bundle the Product in all of them, then you have to purchase three In-Stock license for that exact variation (i.e. WordPress release). Similarly, if you have a single unique theme for both WordPress and Joomla, and want to bundle platform-specific versions of our products, then you have to purchase an In-Stock license for WordPress and another In-Stock license for the Joomla version of LayerSlider.

In-Stock usage is only valid with an In-Stock Usage Permission for each of your End Products. To acquire such permission, you need to register your work on the following URL: kreaturamedia.com/in-stock/
Registering your themes is automated, only takes a couple of seconds, and we only need the most basic details of your theme such as its name. There is no review process involved. However, it is really important to perform this step, so we can whitelist your work in automated content removal (DMCA takedown) services.

Bundled version of the Product cannot be offered as a stand-alone product. Your End Product must be configured in a way to automatically activate & deactivate bundled items whenever users are switching to or away from your product.
For example, you cannot share LayerSlider as a stand-alone item with your customers (e.g. separately include it in the download package, offer to download it from your website, etc). You need to make conscious efforts to integrate it as one with your product. When customers are switching away from your product, the bundled item should follow suit and customers should not be able to use them separately.

Offloading the bundled Product is permitted if you offer no direct access to their install packages and implement satisfactory protection so other than your customers cannot access it.
Usually, you need to use keygates (i.e. Product Activation), so pirated copies of your theme will not serve the Product for unintended audiences. Since your theme is the platform and medium that serves the Product, Offloading shall not be a way to defy and abuse the DMCA system and your work may still be subject to DMCA takedown notices.

You are allowed to modify and customize the Product. You can change the Product’s default settings, or make your own custom skins and slider templates. You can remove unwanted skins or other components that does not fit right in your work. You can make use of the Product’s components to implement custom solutions and integrations related to and as part of the Product. You can do these things as long as your End Product and use case is permitted under this license.
LayerSlider offers a lot of developer tools. Check out our Developer Documentation. We love the various creative solutions and custom implementations built upon LayerSlider. You, as the theme author, know what’s best for your customers and we encourage and embrace customization of the Product. We’re not restrictive about what can and cannot be changed as long as it is done in a good faith. However, the rules and outlined areas of this license needs to be respected in all cases.

You are responsible to release updates and provide customer support for the Product.
Combined with other authors, our products are being used by millions of people. Since we aren’t asking a cut from your sales, we can’t provide these services for such a large audience alone. Of course, our support team is at your disposal if you encounter an issue or questions that you cannot solve or answer. You can also reach out to us if you have suggestions concerning the plugin development.

You are responsible to avoid misleading statements or misrepresentation. Do not rename, hide or otherwise manipulate Kreatura and the Product branding. Do not state that customers will receive a direct license for the Product or promise official support from Kreatura.

You are not allowed to alter the Product in order to offer premium features and/or content for your customers that otherwise would be payable or require a direct license. Modifying the Product to use it for unintended purposes is strictly prohibited. This includes, but not limited to: faking product activation, sharing the template store contents, hiding or removing product activation features or UI elements (including banners and messages), etc.
Don’t forget, offering only a handful of exclusives in an otherwise premium and feature rich product that is in no way a “Lite” experience is also a way to fight against piracy. We try not to nag people, but you are not allowed to hide or change the parts that you don’t like. Bundling our products is a small one-time investment and we don’t ask a cut/share from your sales. It’s only fair that you don’t try to undermine those who want to support the product development by purchasing a license. We’ll always emphasize that it’s optional and will not use misleading text.

By bundling our Product(s) in your End Product you acknowledge and accept these terms and conditions. You take responsibility to correct any breaches of these terms upon discovery. Kreatura is committed to provide a fair conduct and work together with you to resolve any conflicts and provide enough time to make any necessary changes. Kreatura reserves the right to revoke your In-Stock usage permission with immediate effect in severe cases of breaching of these terms and conditions. Cases where we cannot reach an agreement might also result in legal ramifications.
We believe in honest mistakes. We’ll notify you multiple times before taking any actions and will provide a wider time frame to discuss and resolve any issues. We’ll make every effort to settle these cases peacefully whenever it’s possible.

Definitions
Product | Any one of our products (i.e. LayerSlider), including related materials that may be downloaded separately. |

Single Website | A single website. Subdomains and individual sites in a WP Multisite environment are considered different sites, unless they are merely used to provide special landing pages or localized versions of the same site. |

Free | No fee is paid by the end user to access the End Product. The End Product is not sold. No fee is paid to subscribe to a service that includes the End Product (eg a website subscription fee). |
Sell or Sold | Sell or distribute for any type of fee or charge. |
Offloading | The Product is not physically present in the End Product, instead it is made available in other means such as a downloadable content served from an internet server. |
